There are several parts to a workers’ comp case. First of all, you get paid two-thirds of what you were making for every week you’re out of work. The second thing you are entitled to is to get all of your medical bills paid. And the third thing you’re entitled to is some type of final settlement. Now when you do your final settlement there are several ways you can settle. The first way is called a “clincher”. That’s a pretty drastic thing to do which most settlements are done in clincher form. The clincher also takes away your existing right to make an additional claim within the next two years. So they are basically buying out your right to make a claim on your existing injury for the next two years. They should pay you some more money for the clincher. Other ways to settle it is just to settle on your rating or to settle on your condition at the time and keep those two years open.
